COURSE OVERVIEW

This comprehensive course examines and explains the intricacies of structuring and legal documentation for various forms of Islamic financial transactions. Participants will gain a comprehensive understanding of the legal, regulatory and Shariah frameworks governing Islamic banking and finance in Malaysia and the critical roles they play in ensuring compliance with Shariah principles. Through a series of engaging modules and practical case studies, this program will equip attendees with the knowledge and skills necessary to structure robust legal documentation for Islamic financial products.

    • Analyse recent Shariah issues in Islamic financial product documentation.
    • Assess their impact on product development and structuring.
    • Evaluate the role of documentation in mitigating Islamic banking risks.
    • Implement risk management best practices through effective documentation.
    • Examine the latest legal issues in products.
    • Apply Bank Negara Malaysia policy documents in these contexts.
    • Understand legal and documentation issues in Murabahah, Ijarah, Tawarruq, Waad and Wakalah contracts.
    • Discuss Bank Negara Malaysia's policy documents for various products.
  • Upon completion of this course, participants will be able to:
    • Understand the legal and regulatory framework for Islamic banking in Malaysia.
    • Differentiate between the various Shariah structures employed in Islamic banking in Malaysia.
    • Understand key legal and Shariah issues relevant to product structuring.

EXPERT COURSE DIRECTOR


Dr Syed Adam Alhabshi
Partner, Raja, Darryl & Loh

Dr Syed Adam Alhabshi is a Partner at Raja, Darryl & Loh and heads the Islamic Finance Practice Group. He holds a Ph.D in Islamic Finance from the International Centre for Islamic Finance Education (INCEIF) (2016). He also holds a Chartered Islamic Finance Professional (CIFP) from INCEIF (2011), and read law at the International Islamic University of Malaysia (IIUM) (2006).

Professionally, he is qualified as a Chartered Professional in Islamic Finance (CPIF). Dr. Syed Adam is also the Internal Auditor and an Associate Member of the Association of Shariah Advisors in Islamic Finance Malaysia (ASAS). He previously served as the Honorary Secretary and a Grand Council Member of the Chartered Institute of Islamic Finance (CIIF) (2015-2023).

He currently sits on the Islamic Finance Committee of Bar Council Malaysia as the Co- Chairperson.
