COURSE OVERVIEW

This comprehensive course examines and explains the intricacies of structuring and legal documentation for various forms of Islamic financial transactions. Participants will gain a comprehensive understanding of the legal, regulatory and Shariah frameworks governing Islamic banking and finance in Malaysia and the critical roles they play in ensuring compliance with Shariah principles. Through a series of engaging modules and practical case studies, this program will equip attendees with the knowledge and skills necessary to structure robust legal documentation for Islamic financial products.

    • Analyse recent Shariah issues in Islamic financial product documentation.
    • Assess their impact on product development and structuring.
    • Evaluate the role of documentation in mitigating Islamic banking risks.
    • Implement risk management best practices through effective documentation.
    • Examine the latest legal issues in products.
    • Apply Bank Negara Malaysia policy documents in these contexts.
    • Understand legal and documentation issues in Murabahah, Ijarah, Tawarruq, Waad and Wakalah contracts.
    • Discuss Bank Negara Malaysia's policy documents for various products.
  • Upon completion of this course, participants will be able to:
    • Understand the legal and regulatory framework for Islamic banking in Malaysia.
    • Differentiate between the various Shariah structures employed in Islamic banking in Malaysia.
    • Understand key legal and Shariah issues relevant to product structuring.

Dr Syed Adam Alhabshi
Partner, Raja, Darryl & Loh

Dr Syed Adam Alhabshi began his legal career as a Judicial Officer between 2007 and 2011 serving as a Magistrate and a Senior Assistant Registrar in the Muamalat Division and the Commercial Division of the High Court, both in Kuala Lumpur. He also served as the Special Officer to the Chief Justice of Malaysia. Prior to joining Raja, Darryl & Loh, Dr Syed Adam was the Manager of the Shariah Secretariat under the Group Secretarial & Legal Department of a Malaysian financial institution and subsequently a partner in another large firm in Kuala Lumpur from 2018 to 2022. With a Ph. D in Islamic Finance and various other credentials, his focus has been on Islamic finance from the inception of his practice. He has wide experience in advising financial institutions on multiple aspects of Islamic finance (including banking and security documentation), regulatory compliance, Islamic capital markets and Takaful.

September has got off to a strong start for dollar September has got off to a strong start for dollar-denominated Sukuk, with issuance in the first week already matching the combined total raised in July and August.

Four benchmark Sukuk have been printed so far this month: the Islamic Development Bank (IsDB)’s US$1.5 billion offering, its second in 2026; Arab National Bank’s US$750 million Additional Tier 1 Sukuk; Kuwait International Bank’s (KIB) unsecured US$500 million paper; and the Saudi government’s US$3.25 billion Sukuk. The dollar pipeline is looking promising with alrajhi bank preparing to tap the market with a Tier 2 social Sukuk.

The Saudi government issuance is notable given that Fitch Ratings had said in July that it was not anticipating any new public external US dollar sovereign Sukuk in the second half of 2026, after Saudi Arabia concluded its funding plan. Malaysia’s US$1.5 billion return to the dollar Sukuk market in July was similarly notable, coming after a five-year hiatus.
